Without significant breakthroughs, work continued in February on other previously submitted draft laws. Notably, these include: a law significantly reforming the operating principles of housing communities, and a law releasing land for residential purposes.

As a reminder, the amendment to the Act on the Ownership of Premises, processed in February, will clarify the legal nature of the housing community and the scope of its liability for incurring obligations, as well as its right to pursue claims on behalf of property owners. Related to the amendment to the Act on the Ownership of Premises is the deregulation of provisions concerning the adoption of resolutions by the community, reducing the formal rigor associated with collecting votes from community members and clarifying the scope of matters not requiring a resolution.

Release of State Land for Housing

Also in February, consultations continued on the draft law concerning the release of state land for housing. This law will enable the minister responsible for construction to transfer plots of land for residential development to municipalities, which previously belonged to the State Treasury, the National Centre for Agricultural Support, or other state legal entities. The adoption of the proposed regulation may increase the availability of unused, high-value land, especially in cities, currently occupied by, among others, railways or the State Treasury.

    Summary

February 2026 was a month dominated by one significant change for the real estate industry in Poland: the implementation of the mandatory linking of real estate prices sold by developers to the usable area calculated in accordance with the latest version of the Polish Standard PN-ISO 9836. Time will tell whether the coming months will accelerate work on other legal changes that will affect the real estate market in Poland. In the coming months, it is worth observing further work on the housing community reform and the law concerning the release of land for residential development.
